学生公寓“天价”收费，你怎么看？

近日，东北大学秦皇岛分校的天价住宿费火了。

 

据红星新闻报道，有学生爆料，在2019年新生入学前夕，东北大学秦皇岛分校提供学生住宿的鹏远公寓，双人间开出16640元/学期的天价，其中住宿费1200元，剩余14000多元都是“服务费”、“设备使用费”等。

 

The apartment, run by a company, charges each student 16,640 yuan ($2,324) per year for a shared room which can accommodate two students of Northeastern University at Qinhuangdao, the report said.

该报道称，这套公寓由一家公司运营，一间可容纳两名东北大学秦皇岛分校学生的合住房间，每个学生每年的租金为16640元（2324美元）。

 

Hongxing News reported that dormitories at the university campus do not have sufficient space for students, forcing some to live in the Pengyuan Apartment.

《红星新闻》报道称，大学校园的宿舍没有足够的宿舍供学生使用，导致一些学生被迫住在鹏远公寓。

 

   

 

But its price is high enough to rent a house of more than 100 square meters with three bedrooms near the campus, the Finance and Economics website reported.

但据财经网站报道，该学生公寓的价格高到足以在校园附近租一套面积超过100平方米、有三间卧室的房子。

 

The upper limit of school’s dormitory accommodation charges must be under 1,200 yuan per year, according to relevant regulations of Hebei Bureau of Commodity Price.

而根据河北省物价局的相关规定，学校宿舍住宿费的上限必须在每年1200元以下。

 

   

 

A platform of Pengyuan Apartment showed the exceeding part - 15,440 yuan - is for other services, including facilities, room services and water fees.

鹏远公寓的平台显示超过部分——15440元，都是用于其他服务，包括设施使用费，客房服务费和水费。

 

Qinhuangdao Pengyuan College Logistics Service Co, which runs the dormitory, has raised the dormitory price several times in the past years.

Students who refused to pay the extra charge were threatened with eviction or warned they will not be allowed to use electricity.

At Northeastern University’s Qinhuangdao Campus, there are two options for students to live in. One is a dormitory with only six buildings, divided into four-person rooms and six-person rooms, which is only enough for about half of the students, while the other is a Pengyuan Apartment, which is better than the dormitory, said a sophomore female student at the university.

该校一位大二女生称，在东北大学秦皇岛分校，学生住宿有两种选择，一种为学生宿舍，只有6栋楼，分为四人间和六人间，仅够差不多一半学生住，另一种为鹏远公寓，条件比宿舍要好。

 

“Although the accommodation is good, the price is very expensive and always goes up,” she said. This year, the price for a double room was 16,664 yuan, compared with 5,740 yuan last year.

她说，鹏远公寓虽然住宿条件好，但价格非常贵，而且总是涨价。今年1.664万元的两人间，去年仅5740元，其他的房间也都有不同程度的涨价。

 

In January this year, the Qinhuangdao Intermediate People’s Court ruled that Pengyuan’s behavior of charging accommodation fees for student apartments was not a charge for administrative institutions. On the basis of the agreement reached between pengyuan and the students who choose to stay here voluntarily, Pengyuan provides the students with additional services beyond the standard, and clearly states on the charge note that the fees charged are “value-added service fees”, which is a market behavior. Pengyuan Company is a enterprise legal person rather than an administrative unit. The funds received are for self-use and not handed over to the central and local financial special accounts. The Bureau of Commodity Price of Qinhuangdao should not make specific administrative actions based on relevant documents.

今年1月，秦皇岛市中级人民法院判决，鹏远对学生公寓收取住宿费的行为，不属于行政事业单位的收费行为，鹏远在与自愿选择入住的学生达成协议的基础上，向学生提供标准之外的额外服务，并在收费票据上明确载明收取的费用为“增值服务费”，该行为属于市场行为。鹏远公司属于企业法人而非行政单位，所收资金为自用，并不上缴中央和地方财政专户，秦皇岛市物价局不宜依据相关文件对其作出具体行政行为。

 

After receiving the court’s ruling, the local Bureau of Commodity Price sent a letter to Qinhuangdao Development and Reform Commission on February 26, proposing to standardize the charging policy for student apartments held by social forces, according to reports. But no progress has been made.

据相关报道，当地物价局在接到法院判决后，于今年2月26日发函给秦皇岛市发改委，建议对有关社会力量举办学生公寓的收费政策文件予以规范。但目前此事仍无进展。

 

对于东北大学秦皇岛分校“天价”宿舍收费问题，北京京谷律师事务所主任李长青认为，根据国家规定，每学年宿舍费最高为1200元，这属于政府定价，高额的服务费属于巧立名目，变相涨价，这是违法的。

 

“据学生反映，东北大学秦皇岛分校宿舍不能满足所有学生住宿，并且不允许学生在校外住宿，剩余学生只能选择鹏远公寓。这种情况下，并不是学生自愿选择。”他说，由此，学生与鹏远公司签订的合同，应属于无效合同，依《民法总则》第148条的规定，学生可以向法院提起诉讼，要求撤销合同，退还多收的费用。

 

李长青认为，高校宿舍作为大学的基础配套设施，不能以营利为目的，学校和政府部门应该解决好学生的住宿问题，不能将其随意推向市场。
